JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-02-2019 Petitioner apprehends his arrest in connection with Harsidhi P.S. Case No. 254 of 2014 registered for the offence punishable under Section 379 of the Indian Penal Code. Allegation against the petitioner is of committing theft of motorcycle of the informant.

Submission of learned counsel for the petitioner is that he is friend of the informant and false case has been lodged against him and he has no criminal antecedent. Heard learned APP also.

Having heard both sides and in view of allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which shall be considered on its own merit, without being prejudiced by this order.
