The petitioner seeks bail in a case registered for the offence punishable under Section 379 of the Indian Penal Code. The petitioner was apprehended along with two other accused persons while going on a motorcycle for which a case under Section 414 of the Indian Penal Code was registered. Abhay Kumar is said to have confessed his guilt and disclosed that he also committed theft of the motorcycle on the basis of which the petitioner has been made accused in this case registered under Section 379 of the Indian Penal Code. Nothing has been recovered from the possession of the petitioner.

Considering the facts aforesaid, the petitioner above

Patna High Court Cr.Misc. No.44621 of 2015 (2) dt.24-09-2015 2/2 named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri D.C. Pandey, the learned Judicial Magistrate 1st Class, Sadar, East Champaran at Motihari in Sugauli P.S. Case No. 38 of 2015.
