1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 117(2), 118(1), 352, 351(2), 303(2) and 3(5) of the BNS.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner no. 2 is a woman and the informant alleges that Parmanand Kumar Singh (petitioner no. 3) assaulted his wife with fighter causing injury below her eyes, fracture of bone was also caused and two teeth came out thereafter Parmanand Kumar Singh again assaulted her causing fracture of shoulder thereafter other accused persons also assaulted the wife of the informant and Parmanand Kumar Singh
Patna High Court CR. MISC. No.16378 of 2025(4) dt.23-07-2025 2/3 (petitioner no. 3) also snatched gold chain and earring of the wife of the informant.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that during the course of investigation, the informant disclosed before the police that she was assaulted by Ramanand Kumar Singh brother of Parmanand Kumar Singh and not by Parmanand Kumar Singh. It is next submitted that statement of the sons of the informant was also recorded by the police who also in their statement disclosed that it was Ramanand Kumar Singh who assaulted the wife of the informant. Further, even the informant, at para 2 of the case diary, has disclosed that inadvertently the name of Parmanand Kumar Singh was recorded in the FIR when the occurrence was committed by his brother Ramanand Kumar Singh and Parmanand Kumar Singh works at Pune. It is also submitted that Ram Pyare Singh father of Parmanand Kumar Singh is own brother of the informant and are having land dispute.

Learned counsel for the petitioners thus submits that when the informant who is own brother of Ram Pyare Singh before the police has stated that it was Ramanand Kumar Singh who committed the occurrence whether it would be prudent for the Court to deny the anticipatory bail to Parmanand Kumar Singh. No.16378 of 2025(4) dt.23-07-2025 3/3 is further submitted that specific allegation of assault in the FIR is against Parmanand Kumar Singh but then the occurrence was committed by Ramanand Kumar Singh and there is no specific allegation of assault against Ram Pyare Singh and Kanti Devi.
6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners but then fairly submits that in the case diary, the informant has disclosed that it was Ramanand Kumar Singh who had assaulted the wife of the informant.

Considering the submissions made by the learned counsel appearing on behalf of the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Darigaon P.S. Case No. 36 of 2024, subject to the conditions as laid down under Section 482 (2) of the BNSS.
