Heard learned counsel for the petitioner and the respondents.
The grievance of the petitioner in the present writ petition is non-payment of revised family pension with effect from 01.04.2007 in terms of Resolution No. 820 dated 23.09.2009.
Patna High Court CWJC No.4166 of 2020(2) dt.24-06-2020 2/3 In this case, State Bank of India has filed counter affidavit. In para 6 of the counter affidavit wherein there is specific statement that if the concerned department will write a letter to the Accountant General, Bihar for issuance of P.P.O. and P.P.O. is issued by the Accountant General only then revised pension is payable by the Bank.
Under the aforesaid circumstances, the writ petition is disposed of with liberty to the petitioner to approach the District Programme Officer (Establishment), Muzaffarpur, who shall take steps for revision of family pension of the petitioner in terms of Resolution No. 820 dated 23.09.2009. The office of Accountant General shall also do the needful so that revised family pension shall be paid to the petitioner. Entire exercise in this regard may be completed by the respondent District Programme Officer (Establishment), Muzaffarpur and respondent no.8 within a maximum period of three months from the date of receipt/production of a copy of this order, failing which the petitioner shall be entitled to interest at the rate of 9% per annum from the date of filing of writ petition i.e. 22.02.2020 till the date of actual payment, which shall be borne out from the respondent District Programme Officer (Establishment), Muzaffarpur.
