2. The petitioner seeks regular bail in connection with Dighwara P.S. Case No. 55 of 2020 registered on 22.02.2020 under Sections 420, 406, 34 of the I.P.C. and Section 138 Negotiable Instruments Act
3. As per the prosecution case, F.I.R. has been lodged against two named accused persons including the petitioner against there is an allegation of bouncing of cheque.
4. Counsel further submits that petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 21.11.2023 having no criminal case pending against him.
5. Learned counsel for the State opposes the prayer
Patna High Court CR. MISC. No.13096 of 2024(3) dt.18-04-2024 2/2 for bail.
6. Counsel for the informant vehemently opposes the prayer for bail and submits that the informant is completely innocent. He has given Rs. 18 lakh to the well wisher, sale deed was prepared but unfortunately, it was not executed because all the cheques have bounced.
7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-II, Saran at Chapra in connection with Dighwara P.S. Case No. 55 of 2020, subject to the conditions laid down under Section 437 (3) of the Cr.P.C. (Dr. Anshuman, J) Sunnykr/- U
