The petitioner seeks bail in a case registered for the offences punishable under Sections 414 and 34 of the Indian Penal Code.

The police apprehended the petitioner along with Abhay Kumar and Sunil Kumar who were going on a motorcycle. On demand the petitioner and others did not produce the papers with regard to ownership of the vehicle.

It is submitted that Abhay Kumar confessed his guilt and accepted the factum of theft of motorcycle on the basis of which the petitioner has also been made accused in other criminal case nothing has been recovered from the possession of the petitioner.

Patna High Court Cr.Misc. No.44197 of 2015 (2) dt.24-09-2015 2/2 The petitioner is in jail since 12.02.2015 and has remained in jail for about 71⁄2 months.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Learned Sub-Divisional Judicial Magistrate, Sadar, East Champaran at Motihari in Govindganj (Areraj) P.S. Case No. 38 of 2015.
