The petitioner seeks bail in a case under section 364 of the I.P.C. Later on, sections 302 and 201/34 of the I.P.C. were added. It is submitted that the petitioner is not named in the F.I.R. The name of the petitioner figured in the confessional statement of Raj Kumar Mahto in paragraph no.36 of the case diary. Except the confessional statement, the police could not collect any material to show the involvement of the petitioner. It is submitted that Raj Kumar Mahto has already been enlarged on bail by the court below.

Case No. 685/2013.
