JUSTICE SUDHIR SINGH ORAL ORDER 10-11-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is languishing in custody since 04.02.2015 in connection with Beur P.S. Case No. 22/2015 for the offences instituted under Sections 399, 402 of the IPC and 25(1-AA), 26 and 35 of the Arms Act.
The prosecution story, in brief, is that the petitioner and other accused persons were apprehended by the police and from possession of the petitioner, One .9 mm pistol with cartridges, mobile set and one Motorcycle are said to have been recovered. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. The petitioner is in custody since 04.02.2015 and the charge sheet has been submitted in the case. There is no allegation of tampering with the evidence
Patna High Court Cr.Misc. No.43384 of 2015 (3) dt.10-11-2015 2/2 against the petitioner, One .9 mm pistol with cartridges, mobile set and one motorcycle are said to have been recovered from possession of the petitioner. No compliance of Section 100 Cr.P.C. has been followed.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., Ist Class, Patna, in connection with Beur P.S.
