For the Petitioner/s : Mr. Kailash Nath Diwakar For the Opposite Party/s : Mr. B.N. Pandey, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 16-04-2015 Heard both sides.

Petitioners seek their bail in Jai Nagar P.S.Case No.60 of 2014 registered for the offences under Section 394 IPC. The petitioners are not named in the first information report but during the course of investigation, the looted bicycle and Pass Book were recovered from the possession of the petitioners. Learned counsel for the petitioners submits that the trial has begun and the informant was examined as P.W.1 but he did not identify the petitioners in court.

It appears that both the petitioners duly identified in T.I.P and looted money, bicycle and Pass Book were recovered from their possession. Considering the facts and nature of allegation, I am not inclined to enlarge the petitioners on bail and accordingly, the same is rejected. However, the trial court is directed to expedite the trial and conclude the same as early as possible.
