JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-03-2020 At the outset, the learned counsel for the petitioner seeks to withdraw the present petition qua the petitioner no. 6, who has already been arrested.
Patna High Court CR. MISC. No.8958 of 2020(2) dt.02-03-2020 2/3 Accordingly, the present petition qua the petitioner no. 6, stands dismissed as not pressed.
Heard the learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Bhabua P.S. Case No. 714 of 2019 for the offence registered under Sections 147, 148, 149, 341, 323, 307, 379, 337 and 504 of the Indian Penal Code.
The case of the prosecution in brief is that the accused persons are stated to have arrived at the shop of the informant, variously armed with lathi and iron rod and had assaulted the informant.
The learned counsel for the petitioners submits that the petitioners are innocent, they have been falsely implicated and are having clean antecedents. It is further submitted that most of the injuries are simple in nature and a general and omnibus allegation has been levelled against the petitioners, although there is no allegation of any specific overt act as far as the petitioners are concerned.
Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioners, I deem it fit and proper to admit

Accordingly, the petitioners no. 1 to 5 & 7 to 11, above named, are directed to be released on anticipatory bail in the event of their arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 714 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure. (Mohit Kumar Shah, J) S.Sb/- U T
