The petitioner is in custody in connection with Kahalgaon P.S. Case No. 752 of 2018 for the offences under Sections 30(a), 56(d) of Bihar Prohibition and Excise Act and Section 188, 290, 413, 414 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 22.12.2018. He further submits that the name of the petitioner was disclosed by Krishna Kumar who was involved in delivery of wine and in the instant case seizure list was not prepared in accordance with the mandatory provisions of 100 Cr.P.C. Considering the aforesaid, the Court is inclined to
