JUSTICE RAJIV ROY ORAL ORDER 09-09-2025 It has been informed by the learned counsels present in the Court room as also Mr. Viveka Nand Singh, learned G.P.- 18 that Mr. Jitendra Kumar Roy is no more and it seems Mr. Sumit Kumar was also attached in the office and as such on call, there is no representation.
2. The present petition has been preferred for the following relief/s:
(i) for issuance of an appropriate writ order or direction to the District Collector, Supaul for fixation of the amount of award for acquisition of the land of petitioners for construction of Indo-Nepal Boarder Project in pursuant to provision made under section 21 and 26 of Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Re-settlement Act, 2013 hereinafter referred as RFCTLARR Act, 2013 considering the proposal of land
Patna High Court CWJC No.14980 of 2017(3) dt.09-09-2025 3/3 acquisition prepared adhering to section 12 by the requisitioning authority and the market-value as per the sale purchase through local registry office and further give direction the nature of land mentioned at the time of requisition for acquisition can not be changed in arbitrary manner on the basis of a report of committee which has been not empowered under the Act to be constituted rather the authorities mentioned under the Act and document submitted by them can only be the basis for fixation of amount of award and compensation.
3. In that background, this Court deems it appropriate to allow the petitioners to re-agitate the matter through a different counsel, if they so want.
4. The writ petition is disposed of with the aforesaid liberty.
