2. The petitioner has preferred this application for grant of regular bail in connection with Mali P.S. Case No. 151 of 2024 registered for the offences punishable u/s 303(2) of the BNS, 2023.

3. As per the prosecution case, the informant had parked his motorcycle bearing Registration No. BR248742 in front of his house and in the next morning he found his motorcycle was not at the said place. Accordingly, the FIR against unknown has been registered.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

The petitioner is not named in the FIR rather his name has transpired in this case merely on the basis of suspicion. No TIP has been conducted by the prosecution. The petitioner has eight criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 16.12.2024.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner (Niraj Kumar Singh) is the named accused in Aurangabad (Town) P.S. Case No. 677 of 2024 registered for the offence punishable u/s 30(a) of the Bihar Prohibition and Excise Act and he was arrested with the alleged stolen motorcycle and petitioner was using the alleged stolen motorcycle after changing its Reg. Number.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner above named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Aurangabad in connection with Mali P.S. Case No. 151 of 2024, with a condition/s:-

The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
