The petitioner seeks bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code and under Section 27 of the Arms Act. The informant alleged that five persons on two motorcycles came near the shop of his brother and out of which one person fired causing injury on his armpit. It is further alleged that his nephew had received a call on his mobile number 9576071031 which was made from mobile number 8294845726 and extortion was demanded. It is also alleged that the caller disclosed that the extortion amount be handed over to Birendra Sahni @ Anna Hazari @ Anna, the petitioner of village Bishun by 06.09.2014. Patna High Court Cr.Misc. No.44634 of 2015 (2) dt.24-09-2015 2/2 petitioner is the man of the caller who demanded extortion. It is submitted that the police did not collect any evidence against the petitioner. Except the fact that caller disclosed the name of the petitioner that the money be handed over to Birendra Sahni @ Anna Hazari @ Anna no further material is collected against him. One Pankaj Patel who is said to have fired at the informant has already been enlarged on bail vide orders passed in Cr. Misc. No. 3664 of 2015 and the case of the petitioner stands on the same footing.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge, Muzaffarpur in Sessions Trial No. 74 of 2015, arising out of Aurai P.S. Case No. 187 of 2014.
