The petitioner was granted provisional anticipatory bail vide order dated 03.03.2020 by a Co-ordinate Bench of this Court.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. From perusal of the F.I.R. and the case diary, it is evident that no specific overt act is alleged against the petitioner. No specific injury is attributed against the petitioner. The petitioner has been made accused due to village politics.
Patna High Court CR. MISC. No.6096 of 2020(4) dt.23-02-2022 2/2 Specific allegation of assault is against the co-accused Kunjay Das, who is said to have assaulted the deceased with axe. Considering the facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner by order dated 03.03.2020 is, hereby, confirmed in connection with Nathnagar (Madhusudanpur) P.S. case No.321/19 pending in the court of C.J.M., Bhagalpur.
