The petitioners apprehend their arrest in connection with Bheja P.S. Case No.18 of 2018/G.R. No.318 of 2018 registered under Sections 341, 323, 324, 379, 307 and 504/34 of the Indian Penal Code.

The accusation is that at about 09.00 P.M. on 15.03.2018, when the informant reached at village-Gami (Garha), four persons, named in the F.I.R., including the petitioners stopped him by making firing . Thereafter, on the order of Surendra Yadav, the petitioner no.1, pulled the informant from the motorcycle and Surendra Yadav snatched the gold chain from his neck. At that time, the petitioner

Patna High Court CR. MISC. No.8911 of 2019(4) dt.14-05-2019 2/2 no.2 took cash Rs.25000/- from his pocket. Durganand Yadav caused assault to the informant through farsa on his head. At that time, Shyam Yadav was also assaulted by them.

Learned counsel appearing on behalf of the petitioners submits that the petitioners and the informant are co-villagers and the petitioners have falsely been implicated in this case. The injury of the informant is said to be simple in nature and out of the three injuries, as found on the person of Shyam Yadav, one is grievous in nature. The petitioners have no criminal antecedents. Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Jhanjharpur, DistrictMadhubani, in connection with Bheja P.S. Case No.18 of 2018/G.R. No.318 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
