JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report and for the first time, the name of this petitioner came in confessional statement of co-accused Wazir Ahmad and after that petitioner was remanded in this case from a case which had been registered for the recovery of one bag containing Rs, 4040/-, country made pistol and cartridge from the possession of the petitioner.

The contention on behalf of the petitioner is that the above stated recovered bag was not put on T.I.P and as a matter of fact, no looted property of the present case was recovered from possession of the petitioner.

Patna High Court Cr.Misc. No.44574 of 2015 (2) dt.24-09-2015 2/2 Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gopalganj in connection with Barauli P.S.Case No. 126 of 2014.
