JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and counsel appearing on behalf of the State.

Learned counsel for the petitioner submits that case of the petitioner is similar to the order dated 15.09.2017 passed in C.W.J.C. No.7312 of 2017.

Considering the fact that coordinate Bench have already decided the issue, there is no occasion to decide the matter again. Accordingly, this writ petition is disposed of with the direction to the respondent- District Programme Officer (Establishment), Buxar to examine the case of the petitioner and if it is found that the case of the petitioner is covered by the order as contained in Annexure-3, similar relief may be extended to the petitioner. Final decision in this regard be taken by the respondent-District Programme Officer (Establishment), Buxar within 60 days from the date of production of a copy of the order. With the aforesaid direction, this writ petition is disposed of.
