Petitioners seek bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.
Petitioner no. 1 is wife and petitioner no. 2 is son of the deceased. Allegation is that they assaulted to the deceased and administered poison to death.
Submission is that there is no eyewitness of the occurrence.
The Doctor, who performed postmortem, did not find any external or interal injury on the person of the deceased nor there is any evidence of strong motive against the
Patna High Court CR. MISC. No.7355 of 2019(5) dt.19-06-2019 2/2 petitioners to commit murder of the deceased. Only evidence has come that since deceased was a drunkard, the petitioners were quarreling for money.
Considering the fact that there is no substantial material against the petitioners, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tajpur (Halai) Police Station Case No. 282 of 2018, subject to the condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
