The petitioner is languishing in custody for the offences punishable under Sections 363/366A/34 of the Indian Penal Code and Section 8 of the POCSO Act.

Submission is that the petitioner is not named in the FIR and the matter is of some love affairs between the victim girl and co-accused Santosh Kumar. The victim has alleged in her statement, under Section 164 Cr.P.C., that Santosh Kumar had caught her and pushed in the vehicle wherein the petitioner was also sitting. She has not alleged anything against the petitioner.

Considering the aforesaid fact, let the petitioner,

Patna High Court CR. MISC. No.7885 of 2019(3) dt.12-04-2019 2/2 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Barbigha P.S. Case No.358 of 2018 (POCSO Case No.50 of 2018), with condition that petitioner shall fully cooperate with the investigation of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
