The petitioner seeks bail in Nautan P.S. Case No. 20 of 2014 registered under section 307 and other allied sections of the Indian Penal Code.
The petitioner is alleged to have assaulted the informant with knife on his abdomen and palm. Janki is alleged to have assaulted the informant with khurpi on the back. Learned counsel for the petitioner submits that petitioner is co-villager and there is a land dispute between the parties. Counter case has also been lodged. Petitioner is in jail for about six months. On perusal of the record it appears that the informant got four injuries out of which injury no.1 on the left side of chest and injury no.4 on the back of left side of chest are
Patna High Court Cr.Misc. No.42184 of 2014 (3) dt.10-02-2015 2/2 grievous in nature. Injury no.4 is attributed to Janki. Three injuries are found on front side of chest, abdomen and palm. one injury found on the chest is grievous but the injury found on the abdomen and palm are simple in nature.
Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail. The same is rejected. The petitioner may renew his prayer for bail after remaining nine months in jail.
