JUSTICE MOHIT KUMAR SHAH ORAL ORDER 12-04-2023 The present petition is by way of second attempt at the behest of the petitioner for grant of bail in connection with Alamganj P.S. Case No. 752 of 2018 (S. Tr. No. 05 of 2020), for the offence punishable under Section 365 of the Indian Penal Code inasmuch as the earlier petition of the petitioner for grant of bail was rejected by an order dated 17.12.2020 passed in Criminal Miscellaneous No. 28838 of 2020.

Perused the show cause reply submitted by the learned Additional District & Sessions JudgeIII, Patna City dated 05.04.2023 and considering the averments made therein as also the unconditional apology tendered therein, I deem it fit and proper to accept the explanation submitted

Patna High Court CR. MISC. No.8427 of 2023(4) dt.12-04-2023 2/2 before this Court and drop the proceedings initiated against the said Additional District & Sessions Judge-III, Patna City, Patna.

Perused the report submitted by the learned Additional District & Sessions Judge-III, Patna City, Patna dated 20.02.2023, wherein it has been submitted that five out of nine witnesses have already been examined and for securing presence of the remaining four witnesses, nonbailable warrant has been issued on 17.02.2023 as also the trial is likely to be concluded within a period of thee months.

In view of the aforesaid, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to renew his prayer for bail after expiry of six months from today in case there is no substantial progress in the trial.

Accordingly, the present petition stands disposed off as not pressed.
