JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-09-2019 The respondent Nagar Parishad, Madhubani, has filed a counter affidavit, wherein it has been stated that all the outstanding retiral dues of the petitioner has been paid. The learned counsel for the petitioner though does not dispute the said position existing on facts but he submits that the revised salary and pension on the basis of 5th & 6th Pay Revision recommendation, has not been paid to the petitioner herein. The learned counsel appearing for the Nagar Parishad, Madhubani submits that the revision of salary and payment of pension on the basis of 5th & 6th Pay Revision is under process and the service book has been sent to the State Government for approval.

Having regard to the facts and circumstances of the

Patna High Court CWJC No.17242 of 2017(3) dt.11-09-2019 2/2 case, the present writ petition stands disposed off with a direction to the Executive Officer, Nagar Parishad, Madhubnai to take steps for revision of salary and pension of the petitioner on the basis of 5th & 6th Pay Revision recommendation within a period of three months from today and make payment thereof within the said time frame.
