JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Korha P.S. Case No. 483 of 2019 for the offenses under Sections 384, 386 and 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 28.11.2019. The petitioner was not named in the FIR. He has been roped later on in the instant case as the informant claimed that in the market he has identified the looted fish being sold by one Md. Nihal who disclosed the name of this petitioner in his confessional statement.

Considering the fact that the petitioner has no criminal antecedent and he was not named in the FIR, let the
