The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 323, 307, 326 and 149 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is of shot fire upon the informant by means of fire arms.
It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits petitioner has clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail stating that the witnesses have supported the allegation of shot fire to the injured Sujit Kumar
Patna High Court CR. MISC. No.8869 of 2022(4) dt.14-11-2022 2/2 in para nos.21 and 22 of the case diary.
After considering the aforesaid facts, I am not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is rejected.
