The petitioner seeks bail in a case registered for offences punishable under Sections 302/34 of the Indian Penal Code.

It is submitted on behalf of the petitioner that in the further statement recorded on the same date i.e., 06.08.2013, the informant has stated that while Navin Prasad along with Devendra Prasad was standing while Hardeo Prasad and Suresh Prasad had severed the head of the deceased. It is submitted that Devendra Prasad has already been granted anticipatory bail vide Annexure 2 by a co-ordinate Bench of

Patna High Court Cr.Misc. No.42082 of 2014 (3) dt.21-01-2015 2 / 2 this Court.

Having regards to the facts and circumstances of the case, the petitioner, namely, Navin Prasad is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri D. Kumar, Judicial Magistrate, 1st Class, Sikrahana at Motihari in connection with Madhuban P.S. Case No. 142 of 2013.
