JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-02-2020 After some arguments, the learned counsel for the petitioner seeks liberty to file objection under Section 9 of the Bihar and Orissa Public Demand Recovery Act, 1914, before the District Certificate Officer, Bhojpur, Ara in connection with Certificate Case No. 25 of 2019-20 and till passing of the final order seeks interim protection.

Accordingly, the present writ petition stands disposed of with liberty to the petitioner to file appropriate objection under Section 9 of the Bihar and Orissa Public Demand Recovery Act, 1914 before the District Certificate Officer,

Patna High Court CWJC No.3502 of 2020(2) dt.28-02-2020 2/2 Bhojpur at Ara in the pending Certificate Case No. 25 of 201920 whereupon the same shall be considered by the District Certificate Officer, Bhojpur at Ara and final orders shall be passed under Section 10 of the Bihar and Orissa Public Demand Recovery Act, 1914.

It is needless to state that in case, no objection is filed by the petitioner herein within a period of four weeks from today, the District Certificate officer, Bhojpur at Ara shall pass ex parte orders.

It is further directed that till passing of the final orders under Section 10 of the Bihar and Orissa Public Demand Recovery Act, 1914, no coercive action shall be taken against the petitioner.

The writ petition stands disposed of on the aforesaid terms.
