JUSTICE ASHOK KUMAR PANDEY ORAL ORDER 21-02-2025 Heard Mr. Pankaj Kumar Dubey, learned counsel for the petitioner and Mr. Dinesh Singh, learned APP for the State. 2.The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Vijaypur P.S. Case No. 26 of 2024 instituted for the offence under Sections 341, 323, 324, 307, 354(B)/34 of the Indian Penal Code.
3. The case of the prosecution is that the petitioner along with others arrived at the house of the informant. Pradeep Prasad, Deepak Prasad and Janardhan Prasad tried to pull her with ill will. When the informant tried to rescue herself, coaccused persons along with this petitioner assaulted the informant with lathi-danda and farsa. When she raised alarm, her uncle Prabhunath Thakur and aunt Guddan Devi arrived.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to previous land dispute. From perusal of the order of the trial Court, it is clear that Prabunath Thakur has received sharp cut injury whereas Guddan Devi, the aunt of the informant has received hairline fracture of 4th Rib of right side. The allegation to assault Guddan Devi is not specific rather it is general and omnibus. Nothing specific allegation of assault has been attributed against this petitioner. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Similary situated other co-accused persons have already been granted bail by this court vide order dated 29.11.2024 in Cr. Misc. No. 78536 of 2024.
5. In contra, learned APP appearing for the State has opposed the prayer of bail of the petitioner.
6. Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioners on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or

Case No. 26 of 2024, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. 1st Class, Gopalganj/concerned court subject to the conditions as laid down under section 438(2) of the Cr.P.C.
