Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with C III 131 of 2021 registered for the offence under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 21.10.2022 and there is a recovery of 70 liters of illicit liquor from the possession of the petitioner. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the recovery

Patna High Court CR. MISC. No.8881 of 2023(2) dt.03-05-2023 2/2 of liquor, this application for regular bail is allowed. Let the petitioner, above named, be released on bail after framing of charge, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise, Court No.2, Siwan in connection with C III 131 of 2021.

The learned Exclusive Special Excise, Court No.2, Siwan is directed to conclude the trial of all the cases pending against the petitioner at the earliest.

The petitioner will visit concerned Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner. The petitioner will co-operate in the proceeding of the Court below.
