====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2019 Earlier the prayer for bail of the petitioner was rejected vide order dated 01.08.2017 passed in Cr. Misc. No. 32415 of 2017.

The petitioner seeks regular bail in connection with S. Tr. No. 639 of 2017 arising out of Nardiganj P.S. Case No. 67 of 2015, registered for the offences punishable under Sections 147, 148, 149, 341, 307, 379, 504, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is of kidnapping the son of the informant and causing death to him. It further appears from perusal of record that skeleton was recovered from the place. Submission of learned counsel for the petitioner is that the petitioner is in custody for 22 months and charge has also been framed and he is ready to abide by any condition imposed upon him.

No.18039 of 2019(3) dt.17-04-2019 2/2 Heard learned A.P.P. as well as learned counsel for the informant, they have opposed the prayer for bail of the petitioner stating that the family members of the petitioner are threatening the informant and others, however, according to him he has lodged an F.I.R. in that connection on 23.03.2019 and he had admitted that on 25.03.2019 the injured has been examined in the court. Having heard both sides, considering the facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge, Nawada, in connection with S. Tr. No. 639 of 2017 arising out of Nardiganj P.S. Case No.

67 of 2015, subject to the condition that he will not try to temper with the evidence or threaten the informant's witnesses or his family members and will appear as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
