The petitioner apprehends his arrest in connection with Bajpatti P.S. Case No. 165 of 2019 for the offence registered under Sections 366(A) and 34 of the Indian Penal Code.

The allegation is regarding the accused persons including the petitioner herein having abducted the victim girl. The learned counsel for the petitioner has submitted that the petitioner is innocent, he is having a clean antecedent and has been falsely implicated in the present case. The learned counsel for the petitioner has referred to the statement made by the victim girl under Section 164 Cr.P.C. wherein the victim girl has stated that she had voluntarily

Patna High Court CR. MISC. No.8946 of 2020(2) dt.02-03-2020 2/2 eloped with the petitioner and has also solemnized marriage with him as also wants to stay with the petitioner. It is submitted that the age of the victim girl is in between 18-19 years. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to admit the petitioner herein to the privilege of anticipatory bail. Accordingly, the petitioner, above named, is directed to be released on anticipatory bail in the event of his arrest/surrender before the court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Bajpatti P.S. Case No. 165 of 2019 subject to the conditions as stipulated under Section 438(2) of the Code of Criminal Procedure.
