The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 379, 504 and 506/34 of the IPC.
The prosecution case, as per the written report of Sunil Kumar Chaudhary, dated 11.09.2018, submitted to the Station House Officer, Saharsa Sadar Police Station, is to the effect that all the FIR named accused persons including the petitioners variously armed, entered into the house of the informant and started assaulting the informant with iron rod, danda and fists. They also tried to outrage the modesty of the wife of the
Patna High Court Cr.Misc. No.6961 of 2019(2) dt.07-02-2019 2/3 informant. It is further alleged co-accused, Rajdeep Chaudhary snatched the gold chain of the wife of the informant. It is also alleged that on the order of petitioner no.1, Manju Devi, all the accused persons robbed the house hold articles. It is submitted by learned counsel for the petitioner that the petitioners are the co-sharers of the informant and in the background of drainage dispute, the accusation has been levelled against the petitioners. It is further submitted that injury of the informant's side has been found to be simple. A statement has been made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent. Learned APP submits that the petitioners are named in the FIR.
Considering the accusation against the petitioners being omnibus and general, coupled with the statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Saharsa in connection with Saharsa
