JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-10-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of regular bail arises out of Bettiah Town P.S. Case No.735 of 2014, disclosing offences under Sections 406, 420, 323 and 341 of the Indian Penal Code.
The petitioner was an employee of the informant in his shop. Allegedly, while working as an employee, he is said to have committed theft and misappropriated money, totaling to Rs. 5,52,000/-. Learned counsel, appearing on behalf of the petitioner, submits that it is purely a matter of accounting between the petitioner and the informant.
Patna High Court Cr.Misc. No.45920 of 2015 (3) dt.08-10-2015 2/2 In view of the nature of accusation and the fact that petitioner has remained in custody for nearly five months, this application is allowed. The petitioner, abovenamed, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran, in connection with Bettiah Town P.S. Case No.735 of 2014.
This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, as and when required, and in the event of failure on his part to appear before the Court, on two consecutive occasions, his bail bond shall be liable to be cancelled.
