Let the defect(s), if any, be removed within a period of four weeks from today.

The petitioner seeks bail in connection with Excise P.S. Case No. 351 of 2022 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act. It is alleged that there is recovery of 129.6 liters of country made illegal liquor and the petitioner was passenger in the vehicle from which the said recovery was made. Learned counsel for the petitioner submits that the petitioner is in custody since 16.09.2022 and the petitioner has no criminal antecedent.

Patna High Court CR. MISC. No.8217 of 2023(2) dt.03-05-2023 2/2 Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the clean antecedent of the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 2, Siwan in connection with Excise P.S.
