JUSTICE CHANDRA SHEKHAR JHA ORAL ORDER 06-06-2022 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 379, 504, 506 and 34 of Indian Penal Code and Section 27 of the Arms Act in connection with Nathnagar (Madhusudanpur) P.S. Case No. 187 of 2018.

The allegation against the petitioner is that he along with other co-accused after making an attempt to take away the valuable items of the house of the informant, ran away after open firing.

Accused/petitioner is named in the FIR and in custody since 08.04.2021.

Learned counsel for the petitioner submits that the

No.8503 of 2022(2) dt.06-06-2022 2/2 nature of allegation is general and omnibus and it has also been submitted that there is case and counter case between the parties, showing the previous enmity. He further submits that the charge-sheet has already been submitted in this case, as such, there is no chance of the tampering with the evidence. Learned APP appearing on behalf of the State, while opposing the prayer for bail conceded that the allegation against the petitioner is general and omnibus in nature. Considering the facts and submissions as made above and nature of allegation which is very much omnibus coupled with the fact as charge-sheet has already been submitted, let the petitioner, above named, is directed to be released on bail in connection with Nathnagar (Madhusudanpur) P.S. Case No. 187 of 2018 on furnishing bail bound of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 9th Additional District and Sessions Judge, Bhagalpur.
