JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 24-02-2020 Heard learned counsel appearing on behalf of the petitioner and learned counsel appearing on behalf of the State. The petitioner has approached this Court against preparation of provisional gradation list.

Learned counsel appearing on behalf of the petitioner submits that the petitioner was entitled to the benefit of graduate trained scale. He submits that although the petitioner appeared in the final examination of B.A. (Hons.), 1993 after taking leave from the office but the result was published in the year 1994.

Patna High Court CWJC No.3239 of 2020(2) dt.24-02-2020 2/2 Learned counsel for the petitioner submits that the petitioner has filed representation before the District Programme Officer (Establishment), Lakhisarai for correction of the provisional gradation list which is still pending since 19.06.2018.

Considering the aforesaid, the writ petition is disposed of with a direction to the District Programme Officer (Establishment), Lakhisarai (respondent no.5) to take appropriate decision in accordance with law on the aforesaid representation at the earliest preferably within a period of sixty days from the date of receipt/production of a copy of this order. With the aforesaid, the present writ petition stands disposed of.
