====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 14-12-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

Learned counsel for the petitioners are expected to honour their undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioners is/are apprehending his/their arrest in connection with ABP No. 2415 of 2020 arising out of Jamo Bazar P.S. Case No. 128 of 2020 for the offence registered under Sections 341, 323, 324, 307, 504 and 506/34 of the Indian Penal Code.

Allegation, as alleged against the petitioners is that they assaulted the son of the informant with knife due to which

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in connection with the present case. It is further submitted that the main allegation of stabbing by means of Chura on stomach is against the petitioner no. 3, Munna Kumar to which the informant's son sustained injury. From perusal of the injury report which is annexed as Annexure -2 shows that the injuries are simple in nature caused by hard and blunt substance.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of his/their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM - XIII, Siwan in connection with Jamo Bazar P.S. Case No. 128 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
