The petitioner has preferred this application for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per the prosecution case, on the truck in question being searched 4263 litres of liquor was recovered and the driver of the truck was taken into custody. It is stated that on inquiry the driver disclosed the names of the four accused persons involved in the business of liquor which included the petitioner herein.
It is submitted by learned counsel for the petitioner that the allegations leveled against the petitioner are false and concocted. The only material against him is the statement of a
Patna High Court CR. MISC. No.7522 of 2022(2) dt.08-04-2022 2/2 co-accused made before police. No incriminating article has been recovered from his possession. He is in custody since 2.12.2021 and has no criminal antecedent. Charge sheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the petitioner not being arrested at the spot nor having any criminal antecedent and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Bhagwanpur P.S. Case no. 250 of 2018 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Excise Judge-I, Begusarai.
