The petitioner seeks bail in a case registered under section 302 and other allied section of the Indian Penal Code.
The informant alleged that he along with his son his son Sikandar Yadav and Anandi Turi had gone to forest to cut branch of tree. When they started cutting tree petitioner Sattar Mian along with other ten named accused came and they started quarreling. Thereafter the informant came to his house but his son and Anandi Turi did not return and on the next day the dead body of both the persons were recovered.
Learned counsel for the petitioner submits that there is no eye witness of the occurrence. On mere suspicion the
Patna High Court Cr.Misc. No.41534 of 2014 (3) dt.05-02-2015 2/2 name of petitioner and others have been mentioned in the first information report. On perusal of the record it appears that there is no eye witness of the occurrence. The witness is only suspecting since there was quarreling between the petitioner and others. It is submitted that except the suspicion the police did not collect any tangible evidence to show the involvement of the petitioner.
Considering the aforesaid fact, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Shri B.K. Singh, J.M. Ist Class, Jamui in Kahira P.S. Case No. 83 of 2014.
