JUSTICE SUDHIR SINGH ORAL ORDER 18-12-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Section 366A of the Indian Penal Code.

Allegation against the petitioner is that he had kidnapped daughter of the informant.

It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 26.6.2015. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioner. Under Section 164 of the Code of Criminal Procedure statement the victim girl has stated that she had fallen in love with the petitioner and had gone with her own will. Further, the medical report does not support the allegation made in the F.I.R. On behalf of the State, it is submitted that from perusal of 164 Cr. P.C. statement of the victim girl it would appear that there is specific allegation made against the petitioner that he has forcibly established physical relationship with her.
