Patna High Court Cr.Misc. No.41523 of 2014 (3) dt.06-02-2015 2/3 P.S. Case No. 01 of 2014 registered under sections 406, 420, 467, 468, 471, 120B/34 of the Indian Penal Code.

Ravi Kant Jha , Manager of SIS Cash Service Pvt. Ltd. is the informant. It is alleged that the custodians Suraj Kumar Singh @ Suraj Singh @ Chunnu Singh @ Niraj Kumar Singh and Amrendra Kumar Singh took money from the S.B.I. Red Cross Branch , Muzaffarpur but did not put the same in the ATM and thereby the petitioners being the custodian fled away with Rs. 1,1400000 .Learned counsel for the petitioners submits that the petitioners are innocent and they have not committed any offence. During the course of investigation Kunal Ranjan the Deputy Manager SIS Cash Service Pvt. Ltd. was apprehended and he disclosed that he along with the petitioner defalcated the entire amount. It has come in the statement of Shishir Kumar Jha the then Branch Manager of S.B.I. main Branch Red Cross, Muzaffarpur that on 23. and 24.07.

2014 the petitioners took money from the Bank for putting the same in ATM but the petitioners did not put the money and thereby being custodian fled away with Rs. 1,1400000/- .

Patna High Court Cr.Misc. No.41523 of 2014 (3) dt.06-02-2015 3/3 petitioners after taking only three slips. It appears from the record that both the petitioners fled away with Rs.1, 1400000/- and did not put the same in the ATM. Hence I am not inclined to enlarge the petitioners on bail. The same is rejected. However, the trial court is directed to expedite the trial within six months from the date of receipt/production of a copy of this order. If the trial is not concluded without fault of the petitioners within the stipulated time the petitioners may renew their prayer for bail firstly before the trial court.
