BEFORE THE LOK ADALAT HELD AT HIGH COURT PATNA CWJC No. 12231 of 2016 Petitioner :Jai Narayan Prasad Malakar Respondent :The South Bihar Power Distribution Company Ltd. & Ors Present:- Member(Judicial) :Mr. Justice Rajeev Ranjan Prasad Member(Legal Profession) : Mr. Amish Kumar, Advocate AWARD The dispute between the parties having been referred for determination to the Lok Adalat and the parties having compromised/ settled the case/matter, the following award is passed in terms of the settlement: Learned counsel for the petitioner as well as learned counsel for the South Bihar Power Distribution Company Ltd. are present. Sri B.D. Gupta, Deputy Law Advisor of the SBPDCL is also present.

The grievance of the petitioner is that though there is no departmental proceeding pending against him under the Pension Rules, still his 10% pension has been withheld.

Learned counsel for the SBPDCL and Sri B.D. Gupta, Deputy Law Advisor undertakes that the matter will be examined immediately within a period of four weeks and in case no proceeding is found against the petitioner his payment shall be released.

Learned counsel for the petitioner agrees with this undertaking and submits that in view of the understanding given to him on behalf of the SBPDCL that the matter will be examined and in case no proceeding is found pending against him the payment shall be released, he agrees to settle the dispute. The matter is disposed of in view of the understanding reached between the parties as stated above.

The parties are informed that the court fee, if any, paid by any of them shall be refunded.
