The petitioner is an accused in connection with Town (Begusarai) P.S. Case No. 193 of 2015, registered under Sections 420 and 414 of Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Begusarai.
The accusation is that petitioner along with co-accused Kundan Kumar was apprehended by the Police in connection with Begusarai (Town) P.S. Case No. 192 of 2015 thereafter on the basis of their confessional statement the theft motorcycle was recovered beneath the room of temple.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in this case.
Learned counsel for the State vehemently opposed the
Patna High Court Cr.Misc. No.2811 of 2016 (3) dt.17-03-2016 2/2 prayer of the petitioner and submits that on the basis of the confessional statement of the petitioner, the theft motorcycle was recovered from beneath the room of the temple and the petitioner is also involved in 13 other cases of similar nature. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Accordingly, prayer of the petitioner, above named, is rejected.
