Mr. APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-04-2022 Heard the learned counsel for the petitioners and the learned APP for the State.
The petitioners seek bail in anticipation of their arrest in connection with Bairganiya P.S. Case No. 122/2020 instituted for the offence under Sections 341, 323, 307, 379, 427, 504 and 34 of the Indian Penal Code.
Though the petitioners are said to have assaulted two

No.18221 of 2021(3) dt.15-04-2022 2/3 persons of the prosecution side including the informant and informant has received one grievous injury but it has been submitted on behalf of the petitioner that the accusation is absolutely general and omnibus. It has also been submitted that one Bhola Paswan had lodged a case against the informant of the present case and his family members for having assaulted two female members of his family vide Bairganiya P.S. Case No. 121 of 2020, which was lodged earlier in point of time. Apart from this, it has been submitted that because of the dispute between the parties, a clash had taken place in which both sides have received injuries.
The other victim, namely, Pradip Mahto has received only simple injuries.
Regard being had to the background facts and taking into account that the petitioners do not have criminal antecedents, they are directed to be released on bail, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Bairganiya P.S. Case
