JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-04-2019 This is an application for grant of anticipatory bail in connection with Special Case no. 9891 of 2018 arising out of Khusrupur P.S. Case No. 258 of 2018, disclosing offences under Sections 30(a), 37(c) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case is that the police on information that some persons taking toddy and police raided the place of occurrence and arrested two persons and they said that they have purchased the same from the shop of the petitioner and thereafter, raided the shop of the petitioner and 13 liters liquor was recovered.

Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and at the instance of the apprehended accused persons and he has no

Having heard both sides, considering the above submission and also considering the fact that the petitioner has no criminal antecedent, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case no. 9891 of 2018 arising out of Khusrupur P.S. Case No. 258 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
