JUSTICE SATYAVRAT VERMA ORAL ORDER 10-03-2022 Heard learned counsel for the petitioner and Mr. Bhanu Pratap Singh, learned A.P.P. for the State. The petitioner seeks bail in connection with Samastipur (Muffasil) P.S. Case No. 460 of 2021 instituted for the offences under Sections 414, 467, 468 and 471 of the Indian Penal Code and Section 30(a) and 41 (I) (ii) of the Bihar Prohibition & Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is in custody since 17.01.2022, is a person of clean antecedent, charge-sheet has been submitted in the case and allegation is of recovery of 5302 liters of liquor from truck. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot and came to be
Patna High Court CR. MISC. No.8270 of 2022(2) dt.10-03-2022 2/2 implicated merely because he is the owner of the vehicle and thus, was not knowing what the driver had kept in the vehicle. Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 17.01.2022 and charge-sheet has been submitted in the case and was not arrested from the spot, let the petitioner above named be released on bail on furnishing bail bond of Rs. .3000- (Rupees Three Thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Court -I, Samastipur in connection with Samastipur (Muffasil) P.S. Case No. 460 of 2021.
