====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 17-10-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 448, 323, 307, 379, 504 and 147 of the Indian Penal Code.

As per prosecution case, petitioner along with 15-16 co-accused persons assaulted the informant and his brother with means of iron rod and fist and snatched golden chain from the informant.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that petitioner and informant reside in the same building and the scuffle took place due to petty dispute. Though there is allegation of assault but no injury

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Learned Court of Sub-judge-cum-Additional Chief Judicial Magistrate XIV, Patna in Gandhi Maidan P. S. Case No. 370 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
