Let the defect (s), as pointed out by the office, be removed within a period of four weeks from today. The petitioner seeks bail in connection with a case registered for the offence punishable under Sections 30(a), 30(c), 32, 41(i) of Bihar Prohibition & Excise Act, 2016. The prosecution case, in short, is that on secret information, police reached the place of occurrence and on seeing the police, 15-20 persons fled away by crossing the river. From the place of occurrence, police recovered several utensils meant for commercial production of country-made liquor including 20 liter of country-made liquor, 1200 liter of concentrated jaggrey, steel drums, gas stove, cylinder etc.

It is further submitted that nothing has been recovered from the possession of the petitioner and he is in custody since 07.12.2021, is a person with clean antecedent and charge-sheet has been submitted in the case.

Learned A.P.P. for the State opposes the prayer for regular bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court in connection with Katra P.S.
