The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

It is a case of embezzlement of the government money by the accused persons including the petitioner. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has not received any cheque amount and he has not responsible for doing the work and the co-accused Kanhaiya Kumar Ram is only responsible for the same. He further submits that co-accused Kanhaiya Kuamr Ram is the Chairman and Ward Member for doing the work of Pay

Patna High Court CR. MISC. No.8191 of 2022(2) dt.08-08-2022 2/2 Jal Yojana and in this regard a notice was issued on 05.01.2021 under the signature of Technical Assistant to the co-accused Kanhaiya Kumar Ram regarding completing the rest work of Pay Jal Yojana, which was also received by him. Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-I, Sasaram, Rohtas in connection with Kochas P.S. Case No. 134 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
