JUSTICE SHIVAJI PANDEY ORAL ORDER 03-11-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case instituted for the offences under Sections 341, 343 and 376 of the Indian Penal Code.

It has been alleged that in the mid night the petitioner has entered into the house of the informant and tried to outrage the modesty. When she raised alarm the petitioner has fled away.

Learned counsel for the petitioner submits that the informant is in habit of making false allegation against other persons which is apparent from ASnnexure-4 from where it appears that she has made similar allegation against Ram Deo

Patna High Court Cr.Misc. No.49143 of 2015 (2) dt.03-11-2015 Paswan and so much so submitted that petitioner has been made accused on account of the fact that he has got second marriage to the husband of the informant.

Having considered the facts and circumstances of the case, let petitioner, Md. Qyume Mian, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Ist Class, Vaishali at Hajipur in connection with Tisiauta P.S.
